Exactly, which is why the AG appointed special counsel Jack Smith to take over the two preexisting Justice Department investigations into Trump, one for Jan. 6th insurrection and one for the stolen documents. That cases has ramped up to its climax, with Smith revealing he has everything from documents to recordings to texts and emails proving Trump was responsible.

The fact that hasn't been tried or convicted yet means nothing. The 14th Amendment and the right of states to remove a candidate from the ballot do not require a trial and conviction. The judges have the discretion of applying the Amendment's provisions.
